Terms of Service
These terms apply to hevipublishing.com and artwarsinfo.com. They are a contract if you submit a form or buy a pass.
Agreement records store your IP address, a hash of non-identifying device signals, and the time you agreed, as proof of consent.
1. Who we are
These terms are between you and HEVI Publishing LLC. They cover hevipublishing.com, artwarsinfo.com, and the desks those hosts operate, including Cadence Ingestion, the sync challenge, careers, and Art Wars ticketing.
2. Using the sites
You may read the public pages and submit the forms they offer. You will not break the sites, probe them for secrets, or use them to harass anyone. We may refuse a submission that is incomplete, unlawful, or outside the desk it was sent to.
3. Accounts and submissions
What you type into a form is your submission. You are responsible for keeping it accurate. A submission does not by itself make you a client, a partner, or a credited writer. A later written agreement does that.
4. Catalog and metadata
Titles, splits, PRO numbers, links, and other metadata you send are catalog information. We may store them so a person on the desk can review them. You keep ownership of rights you actually hold. Sending metadata does not transfer those rights until a written agreement says so.
5. Sync and performances
A sync challenge entry or a live-performance application is an offer to be considered. It is not a promise of placement, a set time, or a fee. Samples, interpolations, and uncleared recordings stay your problem to clear before you tell us you can license them.
6. Tickets and payments
Paid passes and sponsorship deposits run through Stripe. We do not take card numbers on these servers. A pass is for the person named on it. Door staff may refuse a pass that does not scan or that was already used.
All ticket purchases, VIP passes, vendor fees, and sponsor commitments for Art Wars Vol. 1 are final and non-refundable. In the event of official event postponement or rescheduling, all passes and agreements automatically transfer to the rescheduled date. In the rare event of outright event cancellation without a rescheduled date, full refunds will be issued to original payment methods within 30 days.
Outright cancellation triggers full refunds for both sponsors and ticket holders within 30 days; postponement rolls all commitments over to the new date.
6A. Art Wars Event Terms
Every Art Wars RSVP and ticket checkout requires you to check the Event Terms box. Checking it records the time you agreed.
Live performances at Art Wars may contain adult profanity.
Minors under 18 must be accompanied by an adult age 21+.
The price shown on artwarsinfo.com is the amount charged at checkout. No fees are added on top.
7. Acceptable use
You will not upload malware, scrape the sites in bulk, or send automated traffic that degrades them. You will not pretend to be HEVI Publishing LLC or another rightsholder.
8. Our intellectual property
The sites, the HEVI and Art Wars names, and the page designs are ours or are used with permission. You may link to a public page. You may not copy the sites into a product of your own.
9. Consent records
Agreement records store your IP address, a hash of non-identifying device signals, and the time you agreed, as proof of consent.
The hash is SHA-256 of your browser’s user agent, screen size, time zone, language, and platform. We do not store those signals themselves. We use the record to show that this version of the terms was agreed at that time. We do not sell the record.
10. Disclaimers
The sites are provided as they are. Forms can be down. Mail can be delayed. A coming-soon page means that desk is not open yet. Nothing on the sites is legal, tax, or investment advice.
11. Limitation of liability
To the extent the law allows, HEVI Publishing LLC is not liable for indirect or consequential damages from your use of the sites. If a court finds us liable, the amount is limited to the fees you paid us in the three months before the claim, or one hundred dollars if you paid nothing.
12. Changes
We may update these terms by posting a new version on this page. The version string stored with an agreement is the version that applied when you agreed. A later version applies to a later agreement.
13. Governing law
These terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law rules. Exclusive venue lies in the state or federal courts located in Virginia.
14. Frivolous Claims, Designated Liability, and Trainable Infrastructure Offenses
This section applies to every catalog submission, metadata file, sync entry, and other material you send to HEVI Publishing LLC.
A. Frivolous and bad-faith claims
You will not file an ownership, copyright, trademark, or other infringement claim that you know is false, that you have no reasonable basis to believe, or that you file to pressure, delay, or harass HEVI Publishing LLC or another person. If you do, you are responsible for the reasonable costs and attorney fees of the people who had to answer the claim, where a court or other authority is allowed to shift those costs. HEVI Publishing LLC may refuse the claim, suspend the related submission, and seek those remedies.
B. Designated liability and indemnification
You are the person designated as responsible for the rights in what you submit. You represent that you hold, or are authorized to administer, every right you describe or offer. You indemnify and hold harmless HEVI Publishing LLC and its members, employees, and agents from claims, losses, and expenses, including reasonable attorney fees, that arise because a right you submitted was not yours to give, was encumbered, or was described incorrectly. This covers claims by writers, publishers, labels, sample owners, and performing-rights organizations. Choosing full publishing representation makes this indemnity a condition of the submission. Choosing administration only does not give HEVI Publishing LLC your ownership share, and it does not excuse a right you do not hold.
C. Trainable infrastructure
You will not scrape, crawl, copy, or otherwise take the submitted catalog, metadata, lyrics, audio identifiers, or other site content to train a machine-learning or artificial-intelligence model, or to build a dataset meant for that training, unless HEVI Publishing LLC has given prior written consent. A public page is not that consent. If you do, HEVI Publishing LLC may block your access, require you to delete the material and any model or dataset built from it, and seek injunctive relief and damages to the extent the law allows.
